“Soul Taine” (referred to as “st”, “we”, “us” or “our”) is a brand of “bY Nurs Company” and operates under the domain name “soultaine.com”. You can contact us via info@soultaine.com.

0.1 General

Through the Soul Taine app, we offer a music streaming service, where you can, among other things, listen to radio stations and use various features. By using our app, you agree to these terms. If you do not agree with the terms, we ask that you do not use the app.

1. Features

– Access to and listening to various radio stations
– Seamless connection with Soul Taine headphones and earbuds
– Ability to adjust volume and equalizer settings as desired
– Receive notifications and updates

– Direct contact with our customer service for support

2. Use of the App

Bluetooth connection: By using our app, you agree to the use of Bluetooth technology to connect with the headphones we provide. This allows you to enjoy a personalized listening experience.

Volume and equalizer settings: The app offers functions such as volume control and equalizer settings. You agree to use these functions responsibly to prevent hearing damage. Note: using the app at too high a volume can cause hearing damage.

Radio function: The app allows you to listen to radio stations. Please be responsible when selecting legal and appropriate content.

3. Radio Stations and Data Usage

The websites, including online streaming, displayed as search results or referenced by the Soul Taine app, are owned and operated by individuals and/or companies over which Soul Taine has no control. Soul Taine assumes no responsibility for the content of any website or other source included in search results or referenced by the Soul Taine app. These websites may collect data in their own databases. Soul Taine has no access to these databases and does not collect user data while listening to content. Logos and links to radio station streams are the copyright or trademark of each respective radio station.

If you manage a radio station and would like us to add it to our list, you can contact us, and we will gladly do so.

If the owner and operator of a linked website for any reason wishes to have the radio station removed from the Soul Taine app, they must contact Soul Taine by email and explicitly request removal.

This app uses images to display radio stations. We consider this to be “fair use.” However, if you believe content in our apps infringes on copyright, we ask you to contact us so we can investigate and remove inappropriate content.

Please note that Soul Taine is not responsible for the content broadcast on the radio stations listed in our apps. The Soul Taine app does not verify the accuracy or completeness of the information provided by these stations. Therefore, we are not liable for any inaccuracies or missing information.

Although we do our best to offer a comprehensive and up-to-date list of radio stations worldwide, a station may become unavailable or be removed from our directory at any time.

3.2 Responsibility for Data

Users are responsible for the data they share with radio stations by listening to their streams. We recommend reading the privacy policy of each radio station to understand how they use your data.

When listening to radio stations, the station operator may collect technical data such as IP address as part of their own streaming infrastructure.

Soul Taine does not access, collect, or control any data processed by external radio stations.

3.3 Data Management

Don’t want to share data with radio stations? You can disable the radio function in the app. You can also contact the radio stations to have your data removed.

Note: illegal or inappropriate content may result in the termination of your account.

4. Privacy

The data controller, Soul Taine (soultaine.com), respects the Belgian law of December 8, 1992, regarding the protection of personal privacy in the processing of personal data.

The personal data provided by the user is limited to the email address. This data is used solely for the purpose of account access, customer support, and essential service-related communication. We do not use personal data for advertising, marketing, analytics, or tracking purposes.

The user has a legal right to access and correct their personal data. The user can, upon proof of identity (copy of ID card), obtain the free written communication of their personal data via a written, dated, and signed request to Soul Taine (soultaine.com) via info@soultaine.com. If necessary, the user can also request to correct data that is incorrect, incomplete, or irrelevant.

When using data for direct marketing: The user can oppose the use of their data for direct marketing at no cost. The user can always contact Soul Taine (soultaine.com) for this purpose.

We treat the data as confidential information and will not disclose, rent, or sell it to third parties.

The user is responsible for keeping their login details confidential and using their password. The Soul Taine app does not use a password-based login system. No passwords are stored or processed.

Soul Taine (soultaine.com) does not collect analytics, tracking data, advertising identifiers, or usage statistics. Only anonymized crash reports provided automatically by the Google Play Console may be received to improve app stability.

As a user of this app, you agree to respect the licenses of all content (such as images) available in our apps. It is not permitted to: (1) extract or reproduce large parts of our database, and (2) use robots, spiders, other automated tools, or manual methods to copy or scrape the content and/or app for any purpose without prior written permission from Soul Taine.

The app may request optional access to the device’s location. Location access is not required for the app to function and is only used when the user explicitly grants permission. Location data is not stored or shared with third parties.

5. Liability

Soul Taine is not liable for any damage you incur by using the app.
You are responsible for the safe and responsible use of the app.

6. Intellectual Property

When offering online radio stations on our website, we respect the intellectual property rights of the involved parties. The radio stations are streamed directly from their original source. No content is copied, reproduced, duplicated, or retransmitted. All material remains the property of the radio stations, and we operate in accordance with applicable laws and regulations.

Due to the nature of online broadcasts, we consider access to these stations to be permitted by the radio stations unless otherwise indicated. In cases where specific permissions are required, we will obtain them or refrain from including the station. We take all necessary steps to ensure that the content is offered directly as provided by the radio stations themselves, without infringing upon their rights.

This policy aligns with current intellectual property laws and ensures fair and proper treatment of third-party material.

7. Changes

Soul Taine can change these terms at any time.
The modified terms will apply once they are published on the Soul Taine website.

If you do not agree with the modified terms, we recommend not using the app.

The Dutch version of these terms of service is the version that applies to your use of the Soul Taine app, and in case of any conflict between the Dutch version and a translated version, the Dutch version prevails.

9. Applicable Law

Belgian law applies, except for the provisions of private international law regarding applicable law.

By agreeing to these terms, you agree to the rules for using our application. If you do not agree with these terms, we recommend not using the app.

10. Dispute Resolution

In case of a dispute, it will be resolved through binding, individual arbitration. However, you have the right to opt-out of arbitration within 30 days of agreeing to these terms.

11. Privacy

We highly value your privacy and limit data collection to the minimum necessary for the app to function.

The Soul Taine app collects only the user’s email address and optional customer support messages.

No device IDs, advertising IDs, analytics data, cookies, or tracking technologies are collected.

The app does not share any personal data with third parties, advertisers, analytics providers, AI systems, or social media platforms.

The app may request optional access to device location.

Location access is not required and is only used when the user manually grants permission.

Location data is not stored, tracked, or shared.

We may receive anonymized crash reports through the Google Play Console to improve app stability.

These reports do not contain personal data.

Data Storage: Email addresses and customer support messages are stored securely on ST’s own server.

No data is transferred to external processors or third-party services.

Article 0: Company data

The brand name “Soul Taine” with its webshop name “soultaine.com”, e-mail address “info@soultaine.com” and phone number +32 496 04 06 19 should be part of “bY Nurs”.

Article 1: General provisions

The e-commerce website of Soul Taine, a company, with registered office at Canadastraat 26, Houthalen / Belgium, VAT BE 0674.856.615, offers its customers the opportunity to purchase the products from its webshop online.

These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“customer”). When placing an order through the Soul Taine webshop (soultaine.com), the customer must explicitly accept these conditions, thereby agreeing to the applicability of these conditions, to the exclusion of all other conditions. Additional conditions of the customer are excluded, unless they have been accepted in advance, in writing and expressly by Soul Taine (soultaine.com).

Article 3: Offer

Article 4: Online purchases

On the Front-End of this webshop and at the top of the menu you can choose a desired product. The word “buy” on the product page sends the customer to the shopping cart, after which the product detail page can also be visited via the product link. The customer can then either continue shopping or pay for the shopping cart.

At checkout, customers are given the option to log in, provided a login has been created. Alternatively, the personal data can be entered such as “name”, “telephone number”, “billing address”, “shipping address”, “email address”. At the end of this step, the customer can choose to create an account based on the data. If not desired, the customer without an account can proceed to the payment module to pay for the shopping cart.

Soul Taine (soultaine.com) is entitled to refuse an order due to a serious failure of the customer with regard to orders in which the customer is involved.

Article 5: Delivery and execution of the agreement

After the article, the orders are usually delivered within 24 hours. Items that are out of stock often take 1-2 business days to be processed first. Under these circumstances, some orders may be shipped on request from our partner Bol’s warehouse to serve customers as quickly as possible.

Articles ordered via this webshop are delivered all over the world.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported to Soul Taine (soultaine.com) immediately.

The risk of loss or damage passes to the customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. Soul Taine (soultaine.com) was offered.

Article 6: Retention of title

The delivered items remain the exclusive property of Soul Taine (soultaine.com) until full payment by the customer.

Article 7: Right of withdrawal

The provisions of this article only apply to customers who purchase items online from Soul Taine (soultaine.com) in their capacity as a customer.

Not completely satisfied with your purchase? You can return your order within 14 calendar days of receiving your order without giving a reason using the return form below. If reasonably possible, you can follow the steps stated in the withdrawal process.

Is it a defect? Please contact customer service first and we will help you further.

During the reflection period, the private individual will handle the goods and packaging with care. He will only unpack or use the goods to the extent necessary to assess the nature, characteristics and functioning of the goods. The basic principle here is that the private individual may only handle and inspect the goods as he would in a shop. Therefore, carefully open the box, look at the product, turn on the product and test it, but do not use it intensively.

The customer is liable for any reduction in value of the goods resulting from handling the goods that goes beyond what is permitted in the previous sentence.

Once the customer has received information from Soul Taine (soultaine.com) about the third party that shipped the product(s) and to which address the product should be shipped, the customer will receive an email confirmation of his/her withdrawal request to Soul Taine (soultaine.com).

To comply with the withdrawal period, the customer must send his/her communication regarding his/her exercise of the right of withdrawal before the withdrawal period has expired.

The customer must return or hand over the goods to the address communicated by Soul Taine (soultaine.com) without delay, but in any case no later than 14 calendar days from the day on which he made the decision to withdraw from the contract. The customer is on time if he returns the goods before the period of 14 calendar days has expired.

To comply with the withdrawal period, the customer must send his/her communication regarding his/her exercise of the right of withdrawal before the withdrawal period has expired.

The direct costs of returning the goods are borne by the customer.

If the returned product has diminished in value in any way, Soul Taine (soultaine.com) reserves the right to hold the customer liable and claim compensation for any loss in value of the goods as a result of the use of the goods by the customer that goes beyond what is necessary to determine the nature, characteristics and operation of the goods.

If the customer revokes the agreement, Soul Taine (soultaine.com) will refund all payments received from the customer to date, including standard delivery costs, within a maximum of 14 calendar days after Soul Taine (soultaine.com). com) has been notified. of the customer’s decision to withdraw from the contract. If the right of withdrawal does not apply, please indicate why in the following categories:

The customer cannot exercise the right of withdrawal for:

– supplying or making available goods or services whose price is subject to fluctuations in the financial market over which Soul Taine (soultaine.com) has no influence and which may occur within the withdrawal period;
– the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
– the delivery of goods that are irrevocably mixed with other products after delivery due to their nature.

RETURN PROCESS

Preferably follow the steps below to return your item(s) quickly and easily:

Step 1: Place all items you want to return in the packaging.
Step 2: Check on the return form which item(s) you are returning, take a photo of the return form and add the return form to the packaging
Step 3: Send a photo of the completed return form to customer service at info@soultaine.com.
Step 4: Take the return to the nearest parcel store. Please keep the shipping receipt until we have confirmed receipt.
Step 5: Once the return is received by Soul Taine, the returns department will process it within 5 days. You will then automatically receive the money back into your account within a few days.

(Can I exchange an item?

It is currently not possible to exchange an item. If your item meets the return policy, you can return the order and place a new order to receive the desired products.)

Article 8: Legal guarantee

According to the law of 21 September 2004 on consumer protection in the sale of consumer goods, the customer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantees do not affect these rights.

Customers are advised to keep proof of purchase, the original packaging of the goods.

For items purchased online and delivered to the customer’s home, the customer must contact customer service and return the item to the address provided by Soul Taine (soultaine.com).

In the event of a lack of conformity of the purchased good, the consumer is obliged to inform us within a period of two months from the day on which the consumer discovered the defect. 9.3 No Rewards for Positive Reviews:

We do not provide financial or material rewards to reviewers in exchange for positive reviews.

9.4 Assessment publication:

We reserve the right to publish, moderate, or remove any review that conflicts with our policies.

Article 11: Sanctions for non-payment

Without prejudice to the exercise of other rights that Soul Taine (soultaine.com) has, in case of non-payment or late payment from the date of the default, the customer owes an interest of 10% per year on the amount paid. In addition, the customer is legally obliged to pay a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Article 13: Infringement of validity – non-renunciation

If any provision of these terms and conditions is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by Soul Taine (soultaine.com) to enforce or exercise any of the rights listed in these terms and conditions will never be constructed as a waiver of such provision and will never validity of these rights.

Article 15: Evidence

The customer accepts that electronic communications and backups can serve as evidence.

Article 16: Applicable law – Disputes

Belgian law is applicable, with the exception of the provisions of private international law regarding applicable law.
